Your use of this site and any of the services offered herein, including without limitation our Services, will be subject to the most current version of these Terms of Use as posted on the site at the time of use.

These Terms of Use are legally binding. Thus, when You submit information or conduct any other transaction via this Website, You are entering into a legally binding and enforceable agreement with Us.

Further, by using the services offered on this site, You acknowledge that You have read, understood, and accept these Terms of Use. If You do not accept these Terms of Use, You may not make use of any of the services on offer.

1. General Information

For Your convenience, We have listed below some general information:

  • “We” are EktaMed a division of Kirco International Ltd, and the terms “Us” and “our” have a corresponding meaning herein.
  • Ektamed is a division of Kirco International Ltd which is a private company with limited liability duly incorporated under the applicable laws of the Republic of Mauritius of 206 St James Court, St Denis Street, 1112-075. We also have offices in Stilfontein, South Africa.
  • Our South African postal address is P O Box 1117, Saxonwold, Johannesburg, South Africa 2132;
  • Our South African Physical address is C/o Duff Scott Hospital, 1 Mines Road, Stilfontein and we will accept service of all legal documents there;

2. Definitions

In these Terms of Use:

  • “Procedures” refers to the medical procedure You desire and which you have indicated in the Enquiry Form you have completed;
  • “Consultant/Healthcare Service Provider/ Healthcare Practitioner/ Doctor/ Specialist” means any doctor, surgeon, nurse, physiotherapist and/or other consultant who are to perform or has performed the Procedures, or any part thereof, as listed on the Website or as may be specified in the Enquiry Form;
  • “Content” means any information, data, text, software, music, sound, photographs, graphics, video, messages, and tags contained on this Website;
  • “Enquiry Form” means the written agreement to be concluded between Ektamed (including its network of service providers and strategic partners) and You prior to any Hospital and or Healthcare Practitioner being assigned to you as per your preference. You need to indicate the details of the person/s accompanying You for this service. The process that will be followed by Ektamed and its Affiliates is presented in Part B, Section 1 below.
  • “Medical Information” means the confidential medical records and status of the potential patient. This information will at no stage be provided to Ektamed. This confidential information will be exchanged directly between You and/or Your current local healthcare practitioner and the chosen hospital/healthcare professional that you have selected.
  • “ECT Act” means the Electronic Communications and Transactions Act 25 will be followed by Ektamed;
  • “Facilities” means the facilities at which the Procedures will be conducted and includes, but is not limited to clinics, hospitals and rehabilitation centres;
  • “Medical Costs” means all the costs related to the Procedures and includes, but is not limited to, the Consultants’ cost, costs of the Facilities and rehabilitation costs;
  • “Privacy Policy” means our privacy policy, which is laid out herein
  • “Services” means the services provided by Us and our Affiliates as laid out on the Website that relates to the Procedures and/or Travel and the making of arrangements in respect thereof;
  • “Facilitation Fees” means our fees for providing the Services rendered as well as any costs incurred by us in providing same;
  • “Terms of Use” means the terms and conditions laid out herein;
  • “Travel” means travel for medical purposes and/or for person/s accompanying you for the Procedure only;
  • “Travel Costs” means all costs involved with Travel and includes, but is not limited to, flights, car rental, shuttle services, credit card charges, subsistence and accommodation costs, as may be indicated on the Booking Form;
  • “We”, “Us”, “Our” or “Ektamed” means Kirco International Ltd which is a private company with limited liability duly incorporated under the applicable laws of the Republic of Mauritius of  206 St James Court, St Denis Street, 1112-075(and, unless the context indicates otherwise, its owners, employees, suppliers, internet service providers, agents, and affiliates);
  • Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Cookies are small files that are placed on Your computer, mobile device or any other device, containing the details of Your browsing history on that website among its many uses, and can be recalled by a web server in the domain that placed the cookie.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • “Website” means www.ektamed.com.
  • “You, Your or Visitor” means the User /Potential Patient of this Website and/or the subscriber to our Services as specified in these Terms of Use;
  • The singular includes the plural and vice versa; and
  • Hyperlinks, which are not operational, will not in any way detract from the validity and interpretation of the Terms of Use;

3. General Conditions of Use for this Web Site

  • You agree to use this site in accordance with these Terms of Use, and all laws, regulations and codes of conduct (including self-regulatory) applicable to You and Your use of the Internet and the services provided to You herein. In particular, You agree to use this site only for lawful purposes and in a manner which does not infringe the rights of, or restrict or inhibit the use of or enjoyment of this site by any third party. Furthermore You agree not to use the site in a manner that would bring Us, our business and/or any of our affiliates into disrepute.
  • You acknowledge that Content submitted to this Website by other parties does not necessarily represent our views and that We have not authorised nor endorsed such Content. You agree not to post or transfer to our Website (nor include in any message sent to our Website) any material that is unlawful or violates any third party’s rights, or which is obscene, misleading, inaccurate, defamatory, illegal, in breach of any copyright or other intellectual property right, or damaging to data, software or the performance of our or any other parties’ computer systems.   • We also reserve the right, without notice and in our sole and absolute discretion, to make changes to any parts of the site, inclusive of changes to these Terms of Use. It is Your sole responsibility to review our Terms of Use on each occasion prior to making use of this site. If You continue to use this site after our amended Terms of Use has been posted on the Website, it will constitute an implicit acceptance of such amended Terms of Use. We specifically reserve the right at any time to change or discontinue any aspect and/or feature of this Website without prior notice.

Part B: Website Service Terms

1. Introduction

  • This site is primarily dedicated to the offering of a facilitation service between You and Facilities together with their Healthcare Professional/s of various medical Procedures coupled with travel in a highly personalized manner.
  • Any member of the public that is able to conclude a valid and binding agreement may make use of the Services provided in this Website, provided that they first accept these Terms of Use.
  • You must first complete and submit the Enquiry Form and forward this document to Us via e-mail.
  • We will assign a dedicated person in the Ektamed/Orange Medilink network to your enquiry.
  • At this stage you may make telephonic enquiries with our Partner, Mr Dhawan at Orange Medilink, on +91 97111 70955. They will assign a Team member to your enquiry.
  • We will then contact you and suggest a healthcare practitioner and hospital within the country of your choice where you would like to be treated.
  • We will then contact you by e-mail to present a first pass generic quote with an estimated cost of the medical procedure you require in your preferred country of treatment.
  • The next stage involves a detailed consultation between your healthcare practitioner and the selected facility and their healthcare professional. Usually this involves sharing and discussing your specific medical profile and your specific Procedure. Ektamed and its affiliates are not involved at this stage.
  • Sharing and discussing your specific medical profile and your specific Procedure is conducted directly between the Facility/ Healthcare Practitioner/ your local Healthcare Practitioner and You. The first step is that the selected Healthcare Practitioner will request the details of your local Healthcare Practitioner. The selected overseas facility Healthcare Practitioner will contact your local Healthcare Practitioner and yourself to confirm and obtain further information regarding the information you submitted on the Enquiry Form. Once this is done your personal medical records will be forwarded by your local Healthcare Practitioner to the selected Healthcare Practitioner. It is therefore of the utmost import that You complete the Enquiry Form as accurately, completely and truthfully as possible. If at any time it becomes evident that any of the information provided in the Enquiry Form is false or incomplete, the Consultant will be entitled to refuse any further consultations or to perform the Procedure outright.
  • In order to book Procedures via our Website, our Consultant/Healthcare Practitioner, with a hospital in the preferred country of treatment, performing the Procedure needs to approve You as a possible candidate for the requested Procedure by means of an initial consultation with You and your local Healthcare Practitioner.
  • In some cases, depending on the Procedures involved, the Consultant may contact you directly by telephone or via e-mail.
  • As regards any organ transplantation, necessary legal formalities shall follow ‘Human Organ Transplantation Act’ of the country where such transplant is being performed for the patient. For example, In India, ‘Human Transplantation Act of India’ shall be applicable, and transplant will depend on the availability of the organ or only first degree relative will be considered for organ donation (viz., Liver / kidney).
  • Once the Consultant has identified You as a possible candidate for the requested Procedure, a more firmed up cost estimate of the Procedure to be conducted will be sent to You and your local Healthcare Practitioner.
  • Once You have received the firmed up cost estimate You need to make full payment for the Procedure either personally by You or your medical insurance/medical aid. Payments by You at this stage are made directly to the selected Facility and/or the selected Healthcare professional – including the cost of the first consultation session. Ektamed and its Affiliates are not involved in settling any Procedure bills with the Facility and/or the selected Healthcare Practitioner. This is Your responsibility.
  • Proof of 100% payment to the medical facility needs to be forwarded to the following email address as well: orangemedilink@gmail.com
  • We urge You to familiarise yourself with the cancellation policies of the Facility/ Healthcare Practitioner regarding the financial implications for you should cancellation or postponement be considered for your Procedure for any reason whatsoever. Ektamed and its Affiliates will not be liable for any financial implications arising from cancellations or postponement.
  • Once you are at the Facility, dealing with any complications specific to your health and condition may result in additional costs. This will be for your account. During this final consultation, and notwithstanding the fact that You are already in the country of treatment of choice, the Consultant will be under no obligation to approve You for the Procedure should the healthcare risks be too high.
  • The following service costs are excluded from the medical value travel service fees:
    • Hotel / guesthouse payments are not part of the hospital payments and must be made separately and directly to the hotel / guesthouse in advance.
    • Local conveyance shall be borne by the patient / attendant as and when necessary.
    • Responsibility for converting money in the local currency rests on the client and it is subject to prevailing exchange rate.
    • Local sightseeing.
  • Should you need assistance with Travel Arrangements, accommodation and subsistence arrangement for You and/or the person accompanying you we can assist to make these arrangements and send you a quote regarding these arrangements.
  • We can assist you with post-operative arrangements as well.

2. Disclaimer

  • Information available from this Website is for informative purposes only, and does not constitute medical advice. It is provided to You in order to help You make an informed decision regarding any possible Procedure. You are therefore urged to consult with Your own doctor regarding any potential Procedures listed on the Website.
  • Information regarding potential outcomes and results of the Procedure and rehabilitation times afterwards are provided purely for reference purposes. Actual outcomes and rehabilitation times are subject to each individual’s physical condition and should therefore be thoroughly discussed with the Consultant to avoid any potential disappointment regarding the anticipated outcome and results of the Procedure or subsequent rehabilitation.
  • You are responsible for any financial or health implications arising from cancellation or postponement of your Procedure. We urge you to get written confirmation for your selected Facility regarding cancellation or postponement implications – financial or health related. Regarding financial implications of cancellation or postponement you need to familiarise yourself with the financial implications regarding accommodation and travel implications. You are accordingly advised to obtain travel insurance, if available, to cover Your risks in the event of your cancellation.

3. Limitation of Liability

  • We accept no liability for any damage, loss or liability of any nature, howsoever caused, relating to Travel, including without limitation due to:
    • any flights or other transport being delayed or cancelled;
    • luggage being damaged, stolen or lost; or
    • bad weather.
  • All offers are subject to the specified Travel option, Consultant and Facilities being available at the desired time.
  • We accept no liability for any damage, loss or liability of any nature, howsoever caused relating the Procedures, including without limitation due to:
    • the Procedure not taking place due to any reasons whatsoever, including without limitation delays caused by Travel or Your health;
    • any injuries You might suffer prior to the Procedure or any condition(s) rendering You unfit for the Procedure which at any stage leads to the cancellation thereof;
    • the supply of false, incomplete or insufficient information by You in the General Enquiry Form;
    • the Consultant’s refusal or inability to perform the Procedure at the conclusion of Your final consultation, for any reason whatsoever;
    • any negligence, gross negligence, misconduct or omissions by Us or on behalf of the Facility, its staff, the Consultant or any other persons involved with the Procedure;
    • Your own choices regarding the Procedure; or
    • Your reliance on information provided by the Website or the Consultant.
  • The Consultant is under no obligation to proceed with the Procedure and his/her decision regarding the Procedure is final. We will not be liable for his/her refusal to proceed with the Procedure at any time, although we will endeavour to assist You to obtain the services of an alternative Consultant, if available. All agreements regarding the Procedure are entered into between the Consultant and You and thus We will not be liable for any Medical Costs, expenses or claims arising from the Procedure.
  • By accepting these Terms of Use, You indemnify Us against any costs, damages or claims, howsoever arising, relating to your Travel, or the associated Travel Cost or Medical Costs.

4. Costs and Payment

  • All procedure costs will be made available as per the strict process presented in Part B Section 1 above. All costs are listed in USD.
  • All Travel Costs and Service Fees will be quoted to you in USD and are subject to change.
  • The full amount will be payable before we will make any final arrangements for Procedures or Travel if the arrangement to conduct a procedure is made on a personal and/or private basis. Should the Procedure be approved by a medical insurance or medical aid scheme the full costs for the Procedure and Healthcare Practitioner costs will need to be paid to the Facility prior to any Procedure being conducted. Should your insurance company cover your travel, accommodation and subsistence costs this benefit and payments should be kept separate from the professional costs for the procedure (ie. Healthcare facility costs and healthcare practitioner costs).The full amount due is payable by no later than thirty (30) days prior to the date of Your departure from the country of origin failing which your Booking may be cancelled unilaterally by Us.
  • You will be responsible for all relevant Bank fees, transfer costs, commissions from banks (Yours and Ours) and costs relating to currency exchange in the process of payment to Us. This refers to any payment made, whether it be Cash, Paypal, Credit Card payments or EFT bank transfers.
  • The remainder of the Travel Costs and Service Fees (after payment of the Deposit), as invoiced by the travel service providers, are to be settled by You in full before Your departure from Your country.
  • Medical Costs presented after consultation with the selected Healthcare Practitioner are estimations only of the costs involved in the Procedure. Estimated costs are to be confirmed with the Consultant during final consultation before the Procedure.
  • We will not be held liable for the payment of any Medical Costs relating to the Procedure, and You will be responsible to settle same directly with the relevant third party. Certain Consultants may require payment prior to performing the Procedure, which will be Your responsibility.
  • If you cancel the booking at any time, you will be held liable for all costs already incurred by the Facility with regard to the Services provided up to date of cancellation. Without limiting the generality of the aforesaid, You will forfeit your deposit or payment as per the cancellation policy of the selected Facility.
  • For all Accommodation booked by Ektamed and its Affiliates for You, for Your surgeries and/or treatments, no refund will be given if Your treatment ends earlier than expected or if you decide to return home earlier than expected. All the accommodation is paid upfront and in full to the proprietor of that particular accommodation by you and is non-refundable. Ektamed and its Affiliates will simply facilitate this process and will hold no liability for payments and other matter whatsoever on Your behalf. You may elect to make these arrangements yourself without the facilitation service of Ektamed and its Affiliates.
  • Post-operative costs and care are as per the experience of the Facility in conducting similar procedures as You have opted for. If, however, You feel that You require additional nursing, additional costs may be charged by the Facility. This will be for your account.

Part C: Complaints and General

  • We aim to provide You with a quality service. If, however, You feel that You are not satisfied and have cause to complain, You can contact Us at the email address given in section 1 of Part A above. We will do our best to resolve any problems that may arise.
  • Use of this Website and the interpretation of the Terms of Use is subject to the laws of the Republic of South Africa. We however may approach any court of competent jurisdiction to adjudicate on any dispute arising from or in connection with these Terms of Use notwithstanding that the amount in dispute may exceed such court’s jurisdiction, and You consent thereto.
  • These Terms of Use and the terms incorporated herein by reference constitute the entire agreement between You and Us with respect to Your utilisation of this Website. With regards to the Services offered here, a separate Booking Form will be entered into between You and Us. These terms and conditions will apply in both instances.
  • Any failure to enforce any provision of this agreement on Our part will not be construed as a waiver of any provision or right. In the event that a portion of this agreement is held unenforceable or invalid by any competent authority, the unenforceable portion will be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions will remain in force and effect to the fullest extent permitted by the law.
  • We will have the right to cede, delegate, transfer and assign our rights, obligations and duties hereunder to any person and/or entity, and You hereby consent to such cession, delegation, assignment and transfer as determined by Us.
  • We will be excused any failure to perform or delay in performance of any or all of our obligations hereunder as a result of an event of force majeure, including without limitation acts of God (including flood, fire, earthquake or other similar events), riots, war, strikes, lock-outs or other industrial disputes, epidemics, failure of power systems, failure of telecommunications systems, failure of the world wide web, any outages of the internet or related connection or communications, governmental restraints and act(s) of legislature, or any other cause outside our reasonable control.

The Terms of Use of the Website and this Disclaimer can be amended or changed without a prior notice of You. By continuing to use and visit the Website, the You agree to be governed by the Terms of Use even in the situation they are amended or changed by continuing to use and visit the Website, the You agree, that that is his/her responsibility to be aware of any amendments or changes made to the Terms and Conditions.

Service disclaimer
We do not provide health care or services related to medicine. All health care and medical services are provided exclusively by our Affiliated healthcare facilities in respective geographic locations.
We are not responsible for the operation and maintenance of online resources, external links where the Website is posted or any kind of information about products and services of third parties. External links on the Website are provided solely for the convenience of its Visitors.
All information about health care providers and their representatives has been generously provided or collected by them on the Internet from the published advertising materials, which cannot guarantee complete accuracy and reliability.

Information disclaimer
The information provided on the Website is for You to read and intends to provide them with general overview.
